Civil dispute pertaining to prime hotel property given the colour of human trafficking : Court comes to the Rescue
Pune: In a most disdainful and gross misuse of due process of law a civil dispute between well-known affluent family from Pune Gidwani family and one Lalani family has been given colour of human trafficking and accordingly FIR was registered at Yerwada Police Station against Mrs Sonia Gidwani Narhare, who is running Hotel Spring Brook in Kalyani Nagar Pune.
It has been alleged that the premises run by one Sonia Gidwani Narhare (Business Woman And Philanthropist) was involved in human trafficking and raid was conducted at the said hotel and the manager was booked. Sonia Gidwani Narhare filed anticipatory bail application through Adv Vipul V Dushing and contended that commercial suit is pending in respect of said hotel and in order arm-twist Sonia Gidwani Narhare and obtain possession of hotel from her the said property owner Mr Parvez Lalani planned a false raid on the said hotel. Hon’ble Sessions Court Pune, after hearing parties concerned at length granted anticipatory bail to Sonia Gidwani Narhare vide order dated 15.04.2023.
In a further shocking development in the present case the premises in the possession of Sonia Gidwani Narhare was sealed by Investigating Agency in haphazard manner without hearing her side of the story. Sonia Gidwani again approached Hon’ble Sessions Court through her advocate Vipul V Dushing and challenged the malicious action of the investigating agency through a criminal revision petition.
The said petition was allowed after a detailed hearing before Hon’ble P R Chowdhari Court vide order dated 29.04.2025. Hon’ble Sessions Court has strongly condemned the said illegal action of investigating agency and
observed that the possession be given back to Sonia Gidwani Narhare only. That during hearing of said revision petition Mr. Parvez Lalani filed intervention application to claim possession on the said property however Hon’ble Sessions Court rejected the prayer of Mr Parvez Lalani.
Sonia Gidwani Narhare was represented by team of Adv Vipul V Dushing, Adv Swanand G Govindwar, Adv Rohit S Rahinj, Adv Abhinao V Nalawade.
“We were able to demonstrate in the anticipatory bail proceedings and revisional proceedings that the present case is property dispute which has been given the cloak and colour of human trafficking. None of the ingredients of the Immoral Traffic Prevention Act, as well as the Bhartiya Nyay Sanhita, are prima facie attracted in the present case” – Adv Vipul V Dushing
